By registering for The Floral Source retreat in California, you signify your acceptance of and obligation to these Terms, Conditions, Cancellation Policy, COVID-19 Policy, and Liability Disclaimer. If you have objections to any of the following, you should not register.

PAYMENTS, CANCELLATIONS & REFUNDS

The workshop is payable via the link on the California Retreat page. This will secure your place. If you have any questions. please email kelly@thefloralsource.com.

Ticket is non-refundable but transferable to another person for the same event.

Should you cancel your booking due to (but not limited to) health conditions, family emergencies, medical emergencies, personal reasons – for ANY reason whatsoever – please email kelly@thefloralsource.com. Again, the ticket is nonrefundable, but can be transferred to another person for the same event. Exceptions to this policy cannot be made for any reason.

You may pay in full $2650. If a trip balance is not paid upon by the ticket sale close date of March 15, 2023, we will consider your reservation cancelled with no refund.

This retreat has a signup deadline of March 15, 2023. Due to the nature of logistics and costs of planning an exclusive multi-day retreat in California, it is necessary that a minimum of 8 attendees must register. If at least 8 attendees do not register for the retreat, then The Floral Source reserves the right to cancel the event and you will be refunded in full.

The Floral Source reserve the right to cancel the California Retreat for any reason whatsoever. In the highly unlikely event that such a cancellation occurs, all payments received will be completely refunded.

We cannot be responsible for other expenditure and costs such as hotels and flights though. Please make sure you have insurance in place for this.

TRAVEL INSURANCE

Please make sure you have travel insurance in place to cover any eventualities if you are unable to join us. We will not be able to refund your place if you are unable to attend, even if we re-sell it.

Travel Insurance – specifically trip cancellation insurance – can cover some or all of your expenses. No exceptions whatsoever will be made to this policy.

In addition, if you miss a specified group pickup or transfer due to a delayed, cancelled or missed flight or for any reason whatsoever, you are responsible for arranging and paying for your own transportation to the retreat venue.

Note: Terms and coverages vary depending on the specific insurance carrier. Carefully check the specified terms and coverages before purchasing your policy. Some insurance carries require that you purchase a policy within 7 days of booking your trip.

COVID-19 LIABILITY WAIVER

The Floral Source is committed to following all COVID-19 safety protocols, as outlined by the CDC and the State of California, to ensure to the best of our ability each trip participant’s safety during the California Retreat. However, we cannot control everything and everybody. For this reason the trip participant (you) is legally responsible for his/her own safe behavior and agrees to, and is held legally liable to, the following statements:

• I understand and agree that I am responsible for abiding by any and all COVID-19 safety protocols and rules at least 2 weeks before my trip, as well as throughout my trip with The Floral Source – as outlined by the CDC and the State of California and as practiced by The Floral Source. This includes mask-wearing (as required), social distancing, hand sanitizing and the avoidance of large, crowded gatherings.

• I understand that I am not to attend if I test positive for or suspect I have COVID-19, exhibiting symptoms up to 10 days before the workshop.

• I understand The Floral Source recommends I test for COVID-19 before I attend the retreat.

• In the highly unlikely event that I should test positive for COVID-19 while in California, I understand and agree that I must self-isolate up until which time I test negative for COVID-19. The Floral Source will, to the best of their ability, assist me in finding accommodations, however, I am ultimately financially responsible for my extended stay in California, until which time I test negative and am allowed to return home.

In the event that the world shuts down again due to COVID-19, and we have to cancel the workshop due to new restrictions, then we will offer a full refund. We cannot, however offer a refund for individual cases of COVID-19.

LIABILITY WAIVER

While we take every possible measure to ensure each trip participant’s safety during The Floral Source retreat in California, we cannot control everything and everybody. For this reason, the trip participant (you) is legally responsible for his/ her safety and behavior and agrees to, and is held legally liable to, the following statements:

• I am 18 years of age or over.

• I am responsible for choosing to attend The Floral Source retreat in California based on my health, fitness and abilities.

• I understand that The Floral Source representatives are not responsible for participants’ baggage or personal effects, and that I am responsible for purchasing a travel insurance policy to cover any baggage damage or theft.

• In the event of delayed, canceled or missed flights, or other travel delays, I understand that I am responsible for making alternate arrangements and that I am also responsible for paying for my own transportation to the retreat or venue location.

• I understand that all services and accommodations are subject to the laws and regulations of the State of California. The Floral Source acts only as an agent for the various independent suppliers that provide transportation, sightseeing, activities, meals, workshops, tours, or any other services connected with this retreat. Such services are subject to the terms and conditions of those suppliers. The Floral Source’s respective agents, representatives, and assigns accept no liability whatsoever for any injury, damage, loss, accident, delay, or any other incident which may be caused by the negligence, defect, default of any company or person in performing these services.

• I understand that The Floral Source representatives reserve the right to accept, remove, retain or decline any participant at any time for any reason. In such case, no refunds will be given.

• I agree that The Floral Source hereby gives notice that all services and arrangements related to The Floral Source retreat in California have been made upon the express condition that The Floral Source representatives shall not be held liable and do not assume responsibility for any claims, damages, expenses or other financial loss whether to person or property arising out of any injury, accident, death, cancellation, delay, alteration, or inconvenience resulting from any acts of negligence, breach of contract, omission, or by weather, sickness, strike, quarantine, hostilities, local laws or the willful or negligent acts of any other trip participant, or any cause whatsoever.

• I consent and acknowledge that should I require emergency medical treatment as a result of accident or illness arising during my attendance and participation on The Floral Source retreat in California, I am financially responsible for any medical or legal bills that may be incurred as a result of that emergency medical treatment. I will notify The Floral Source representatives verbally and in writing if I am at any time injured prior to, during, or after the retreat, or if I have medical conditions about which emergency medical personnel should be informed; however, I understand that agents of The Floral Source are not legally obligated to act on that information in any way or to providing any medical service whatsoever to me.

• I agree that if I have any medical or psychological conditions that may hamper me from fully and healthfully participating in The Floral Source retreat in California that I will notify The Floral Source representatives and that they retain the right to request that I not participate in portions of or in the entirety of the trip.

• I understand that I am ultimately responsible for my own health and well being, including carrying with me any necessary medications, such as those for chronic conditions and/or allergies to foods, insects, etc. I also understand that I should report to The Floral Source representatives any health-related issues that might affect myself or other trip participants.

• I agree that The Floral Source’s agents or representatives reserve the right to take photographic or video records throughout The Floral Source retreat in California, and may use such records for promotional, marketing, and/or commercial purposes.

• I understand that The Floral Source cannot be held liable for situations beyond their control, including (but not limited to) acts of war, acts of God, threats or acts of terrorism, civil unrest, or unforeseen personal circumstances. I understand The Floral Source cannot offer refunds for illness, flight delays, or any other circumstances.

REVIEW AND JURISDICTION

These Terms will be governed by and construed in accordance with the laws of the State of Maryland. The participant agrees that any dispute that arises out of or relates to these Terms will be resolved via non-binding mediation in the State of Maryland via a professional mediator obtained by The Floral Source and if a successful mediation is not reached, to binding arbitration arbitrated in the State of Maryland in accordance with the policies set forth by the American Arbitration Association. If any of these Terms of use are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms of use, and will not affect the validity and enforceability of the remaining provisions.
